ABSTRACT

This chapter discusses affirmative actions for persons with disabilities as regards access to higher education, and the right to education as a fundamental right and duty in the FC. The subject is the problem of access to education by persons with disabilities. The chapter commences from the constitutional and legal framework in Brazil, structured around the FC, which puts a special emphasis on material equality and anti-discrimination law, including the duty to create affirmative actions, aiming at the inclusion of persons belonging to the most vulnerable social groups. In conclusion, there is a significant increase in the number of persons with disabilities enrolled in basic education. The absolute majority already attends schools in mainstream classes, together with other students, complying with the requirements of the social model and of the Persons with Disabilities Act.
