ABSTRACT

Personal injury (PI) litigation involves tort law. A tort is a civil wrong committed against a person, property, entity, or relationship. Personal injury claims are unintentional torts that involve negligent actions resulting in physical, psychological, or economic harm to the injured party. This includes injuries sustained as a result of motor vehicle collisions, slip and falls, elevator and escalator accidents, other dangerous property conditions, domestic pets, foodborne illness, and foreign objects in food.

A skilled legal nurse consultant (LNC) is of invaluable assistance to attorneys handling personal injury claims. Most PI claims are venued in state court, and thus a basic understanding of the applicable substantive law and procedural rules assists the LNC to extract the relevant information from the medical records, identify the appropriate experts, and assist in an analysis of the causation and damages issues.
