ABSTRACT

This chapter aims to consider the implications of a victim’s politics in the proceedings, and to further hypothesize as to whether the Court should take a different approach based on this political reality. In this way, it considers how to balance a victim’s right to agency with the needs and premises of the Court to find both truth and justice through the proceedings. Applying this analysis, the chapter then moves to consider whether the political reality of victims' participation has an impact on the fairness and efficiency of the proceedings and finally considers some possible ways in which the Court may want to address the issues at hand. Beyond the politicization of international justice, a discussion on the framework of politics and victims and how they interact and exist in tandem is important in order to reflect on the outcomes which these systems may influence.
