ABSTRACT

There has been growing activity in recent years to link the objectives of R2P prevention to the work of the Human Rights Council. The conceptual and operational relationship between human rights and R2P is still being developed in the literature. This chapter examines in detail the link between human rights obligations and R2P, and relates this to the most recent discussion on the need for further clarification of challenges to the implementation of R2P within the human rights community. The chapter then examines the relationship between R2P and human rights obligations of states under international law. The remainder of the chapter provides an outline of a general concept of human rights accountability and compliance for the application of R2P and implementation mechanisms regarding this concept. Conclusions are then drawn in relation to the present political environment of the R2P discussion, and practical and measured recommendations are suggested as a way of moving forward.
