ABSTRACT

This chapter attempts to analyze several cases relating to the United States to see how the People's Republic of China (PRC) has used international law in negotiation. On November 23, 1954, the PRC surprisingly announced the sentencing of eleven US airmen captured during the Korean conflict to long-term imprisonment for the alleged offense of intruding into Chinese airspace and conducting "reconnaissance against China aimed at jeopardizing China's national secutiry." The Chinese translated the phrase "having in mind" into Kaolu, which if translated into English, would mean ""consider." The US president frequently wants to show his diplomatic successes to the public by demonstrating his ability to reach agreements with the PRC. The Chinese Government hopes that the US Government will truly shoulder its responsibility, strictly act on the principles of international law, take effective steps to stop the aggravation of events and handle the case properly so that Sino-US relations and normal trade and economic exchanges may not be impaired.
