ABSTRACT

The story of Kashmir is not one of only Indian intransigence, regional power politics, and political machinations within Kashmir leading to the excessive military suppression and allegations of human rights violations in the 1990s. Pakistan sponsored an armed insurgency in the Valley, exploiting the alienation of the people as a result of the Government of India's continuous pursuit of illiberal policies, in order to obliterate the Simla Agreement and revive Kashmir as an international issue. Article 370 of the Indian constitution had limited the state's accession to defense, foreign affairs and communications, and applied only specified parts of the constitution to Kashmir. In 1986, Jagmohan, the governor appointed by the central government, "concurred" with the central government's request to extend Article 249 to Kashmir which enables Parliament to legislate even on a matter on the State List on the strength of a Rajya Sabha resolution.
