The investigating officer then forwards the record, together with his recommendation, to the commanding officer, who adds his recommendation and forwards it through the chain of command to the headquarters of the service. As in Selective Service processing of conscientious objector (CO) applications, the central question as to the nature and sincerity of the applicant's beliefs requires a judgment on the subjective matter of intent. In United States v. Sigmon, the defendant was court-martialled for disobeying an order to enplane for Vietnam, issued after the military authorities had refused to process his CO claim for discharge. The regulations provide that individuals on reassignment orders may be required to submit CO applications at their next permanent duty station. The Air Force disenrollment process means that ROTC applications are determined by active duty Air Force officers, rather than by the ROTC personnel who are most familiar with the individual involved.
