ABSTRACT

The specific regime of the maritime space is a compromise among different positions that also acted as a balancing factor within the overall negotiations of the conference. The Convention on the Law of the Sea establishes an overall system based on the primacy of procedures leading to a compulsory or binding settlement issued by an international tribunal. The treaty in question contains detailed regulations regarding the procedures as well as the jurisdiction conferred upon the entities called upon to play a role in the various processes. The instances also include the designation of specific zones beyond the 200-mile limit in areas of an extensive continental shelf where activities of exploration or exploitation are to be carried out. In the settlement offered by the convention, the general principle could be applied to any subject area whatsoever. A problem of interpretation could arise with respect to species having a life cycle extending beyond the Exclusive Economic Zone that fall within special categories.
