ABSTRACT

Judiciary is the last resort for common people to seek justice. The Indian judiciary system is very strong in ensuring justice to common people. Sometimes the system fails to deliver timely justice on account of several real life constraints. The broad objective of this chapter is to highlight the main challenges faced by judiciary for timely disposal of cases based on long firsthand work experience as District and Sessions Judge. Firsthand experience says that various factors are responsible behind delayed justice system at the District Court level. Broadly, they include lack of manpower, that is, judges across the country is less as compared to workload, the right of people to approach to higher judiciary if not happy with the judgment of lower court, load of false complaints and seeking more time from the court for collection of evidences, sometimes it is essential while sometimes it intentional for delaying the judgment, disappearance of litigants after lodging a complaints because of threat and lack of evidences. The latest initiative of Supreme Court for live telecast of courtroom proceedings through television channels with a view to speed up the disposal of cases is a wonderful initiative. This approach will not only make the courtroom proceedings open and transparent, it will make all stakeholders responsible and active in the judicial system in addition to ensuring faith of common people and litigants on the judiciary. This apart, every individual should behave in a responsible manner and cooperate with the system for timely delivery of justice. In this regard, case management and monitoring of cases by the management professionals in the system would add additional value.
