ABSTRACT

Legislation and laws form the foundation of process and progress in any nation. They contribute to bridging the gap between what is and what should be. Disability is one area where these need to be understood so that the streamlining of different sects of society can be facilitated in a systematic manner. This chapter explores the present scenario and status of children with disabilities in India, laws concerning different types of disabilities, their relevance, effective implementation and revisions that will make them more public friendly as well as easily enforced. A major concern addressed here concentrates around the availability of proper statistical data on which the different constitutional definitions and legislations are based and vice versa. Also, an attempt has been made to draw parallels between disability laws of different countries so that lessons can be drawn for better rehabilitation of people with disabilities into society. Evidence-based implications and recommendations have been proposed to bring about changes in existing laws keeping in view the ground realities. The chapter concludes with a critical discussion of need of the hour revisions in disability laws, especially for children, and the comparison of the revisions made to the redundant points currently prevailing in these laws.
