ABSTRACT

The bill represents an attempt to reduce the restraints imposed upon the authorities to intervene in the freedom of the individual, in favour of uniform code of politically opportune and – for the police – tactically expedient measures. In order to grasp the extraordinary significance of the bill, it is necessary to examine the function and development of the standardization of state laws. The significance of the standardization of intervention and use of force becomes clearer, when the background of institutional changes in the police apparatus is examined. If a person is suspected of having committed a crime or delict, the police have the right, on the basis of the criminal code, to check his identity and to search his person and articles in his possession. Police actions which had been legally justified for the individual police officer through the self-defence and emergency provisions are no longer handled as justifiable individual actions in borderline cases but as legitimate official acts.
