ABSTRACT

The #MeToo movement gained momentum in 2017 through social media and resulted in holding many high-profile men accountable for sexually inappropriate behavior as well as igniting a broader cultural conversation about the importance of consent to sexual activity. The necessary conditions for consent and problems with proving that they were met are identified and discussed in this chapter. The conditions of voluntariness, competence, knowledge, intentionality, reversibility, and enthusiasm are given special attention. The affirmative consent standard on college campuses is also explored. Ultimately, consent is determined to be important in differentiating morally permissible sex acts from morally impermissible acts but insufficient in determining which acts are criminal.
