ABSTRACT

This chapter discusses a few issues that have arisen as a result of emerging technology. Emerging technologies pose threats to privacy and have the potential to help fraudsters and other criminals to perpetrate crime, but they also help to reduce crime. There is great utility in the police and intelligence services having access to surveillance technology, but such technology could be misused more often if made widely available to private individuals. Artificial intelligence-operated biometric capture technology raises privacy issues beyond those ever raised by closed-circuit television, because it has the ability not only to capture the information but also to sort and analyse it. The key areas covered include are cyberfraud, cybersecurity, data retention laws, digital privacy invasions, liability for intermediaries such as Internet service providers and criminal liability for artificially intelligent entities. The chapter also presents an overview on the key concepts discussed in this book.
