ABSTRACT

The chapter analyzes customary law of Indigenous peoples of the North and its incorporation into the legal system of the Russian Federation. Customary law determines rules of natural resource use and rules regulating social relations within family, community, and society as a whole. The chapter emphasizes the importance of customary law for the study of Indigenous entrepreneurship and lawmaking. Methodological approaches used to research customary law are legal pluralism and libertarian legal theory. This theoretical framework allows showing the equal value of humans and nature in the traditional law system. These issues are dealt with in the chapter based on the author’s field materials collected in Western Siberia and Sakhalin.
