ABSTRACT

The idea of a seabed tribunal as part of the new regime for deep seabed mining under negotiation and with the international organization to be established to administer it. The proposals for a Tribunal made in the negotiations for deep seabed mining disputes and for an international tribunal for the law of the sea (ITLOS) envisaged for other disputes concerning United Nations Convention for the Law of the Sea (UNCLOS) were merged later during the conference. According to UNCLOS article 191: The Seabed Disputes Chamber shall give advisory opinions at the request of the assembly or the council on legal questions arising within the scope of their activities. UNCLOS article 289 provides for the possibility, in cases involving technical or scientific matters, to have experts selected ex officio or at the request of the parties to sit with ITLOS without the right to vote.
