ABSTRACT

This chapter considers the types of contentious disputes that may arise in the context of deep seabed mining operations, the possible legal forums that are available to resolve such disputes, and the nature of the claims that may be made. It analyzes the scope of jurisdiction conferred on the seabed disputes chamber and other courts and tribunals seized under section 5 of Part XI. The chapter assesses what other judicial forums may potentially be seized by actors involved in deep seabed mining operations. It reflects upon the potential consequences arising from the diversity of forums available to settle deep seabed mining disputes. The form of national requirements relating to deep seabed mining can vary from state to state. They can be expressed in the primary legislation, licensing regimes, or contractual arrangements between the sponsoring state and deep seabed mining operators.
