ABSTRACT

Hong Kong is in the process of introducing a title registration system to replace the deeds registration system. It is perhaps appropriate, at an international conference on the reform of property law, to talk about the proposed reform in Hong Kong. The Hong Kong deeds registration system is in some ways similar to the English unregistered system in that registration of deeds does not guarantee the validity of the owner's title. Priority under the deeds registration system as administered in Hong Kong is primarily determined according to the Land Registration Ordinance, and where the interest is not registrable, to the doctrine of notice. The priority of any instruments already registered under the deeds registration system will be preserved as under the Land Registration Ordinance. Rules of priority can affect substantive rights by postponing some interests in favour of others.
