ABSTRACT
This paper assesses one form of public law litigation in Brazilian Courts. It begins by describing the institutional setting of courts and contrasting the general number of cases adjudicated by them with the number of cases dealing with social rights (education and health care). It goes on to enquire about their originality in the legal culture and the role of litigation in defining social rights in legal reasoning.
