ABSTRACT

The Council of the EU sought in its Conclusions adopted on 20 June 2016 an Opinion by the EU Agency for Fundamental Rights (FRA) on access to remedy aiming at supporting the EU’s work related to business and human rights, by offering advice on how to lower the barriers for access to remedies in cases of fundamental rights abuse by businesses in or linked to the EU. Considering that the third pillar of the UN Guiding Principles on Business and Human Rights (UNGPs) is a key aspect to operationalizing the principles, this chapter seeks to analyse the FRA Opinion, published on 10 April 2017, focusing on its contribution to foster EU and Member States’ action to provide access to effective remedies and justice for victims of corporate-related human rights abuses. In order to test its significance and applicability, this chapter analyses the content of the FRA Opinion and highlights perceived weaknesses or gaps.
