ABSTRACT

New paradigms of judging – procedural justice and therapeutic jurisprudence – explicitly acknowledge the importance of judicial interaction with court participants, including the role of feelings and emotion in judicial work. In this chapter, empirical research conducted in Australia describes the experiences and perceptions of emotion, emotion display and emotion work among judicial officers. The chapter demonstrates, and supports the overall conclusion, that, although emotion is often associated with stress, emotion and emotion work are essential elements of communication and can be valuable resources to accomplish everyday judicial work.
