ABSTRACT

In the U.S., there are no uniform codes or laws related to parking regulations. Parking laws and regulations are most often developed and implemented by the governing body of a municipality, county, or other public body with delegated legislative authority. Parking regulations fall into two general categories: on-street and off-street. Individual laws vary in different jurisdictions and from state to state based on the supply and demand of parking facilities. Further, parking regulations themselves also vary town by town based on the demands and customs of the community. These local authorities are faced with managing parking requirements across a number of situations from actual parking enforcement, including on-street, off-street, as well as parking development including zoning, shared-use parking, and payments in-lieu of parking. A parking professional should be aware of the legal basis and public policy considerations that provide the basis for valid on-street and off-street parking regulations.
