Hybrid Theories of Punishment

This chapter examines the hybrid strategy of disaggregating the question of punishment’s rationale from the question of how it should be constrained, and of answering these questions by appeal to different moral considerations. The chapter argues that the hybrid strategy is more resilient than is often acknowledged as an approach to justifying punishment, and that standard objections to this approach are unsuccessful.
