ABSTRACT

Constant changes in the area of digital humanities, such as advancements in technology and digital culture, introduce opportunities for access and preservation. However, these opportunities can also present intellectual property challenges that include developing new copyright policies for digital archives and educating practitioners on modern copyright laws and limitations. In this chapter, I will define relevant intellectual property terms, legislation and cases that have a profound effect in the digital humanities field. Specific topics covered will be fair use, the public domain, Creative Commons, orphan works, seeking permission, donor agreements, and digital rights management. By reviewing the legal groundwork and offering recommendations on how to handle copyright concerns, this chapter will assist students and scholars in the digital humanities.
