ABSTRACT

This chapter discusses some of the non-governmental efforts toward effecting a sound system of pharmaceutical care delivery. The Pharmaceutical Research and Manufacturers Association maintains a Code, as does the Pharmaceutical Marketing Council, which consists of Advertising and other functions which serve the industry. In any case, the legal profession does exert a certain level of control on the drug industry outside of the Government. Apart from their role in Investigation, Legislation, and Regulation, the legal profession is very much a factor in a variety of ways. While not “non-governmental”, the Congress is also involved in self-regulation. Historically, the Pharmaceutical benefits managers (PBMs) industry has been largely free from regulatory oversight. The American Medical Association has the Hippocratic Oath which can be seen, framed, in many physicians’ offices. Central to the arena of third party managed care is the Pharmacy Benefit Managers. The PBM industry provides formulary management as a basic component of the services that it provides to its clientele.
