ABSTRACT

This chapter examines the place of and protection for freedom of religion or belief (FoRB) in Australian government schools. It outlines the legal status of primary and tertiary education in the Australian states and territories; provides an overview of the judicial treatment of constitutional, legislative, and common law protection for FoRB; and briefly touches on emerging issues, suggesting that the courts may soon be required to provide guidance as to how the available protections operate in the government school setting.
