ABSTRACT

This chapter provides both a high-level overview of insurance, including an explanation of the specialized terms commonly used, as well as exploration of the issues unique to insuring cannabis companies. The overview of insurance explains the difference between admitted and surplus line insurers and then describes several of the common types of insurance and what kinds of risks they cover. With respect to cannabis-specific issues, the article covers two of the high-profile cases where insurers made public policy arguments in an attempt to deny coverage, as well as the availability and pricing issues with respect to obtaining insurance for cannabis companies. Finally, the chapter discusses self-insurance options for cannabis companies that are unable to obtain adequate policies.
