ABSTRACT

This work explores the possible contributions that the judiciary may make to our collective conversation over issues of fundamental public interest. The text first discusses some principles that may orient the action of judges in this regard, which are in line with the requirements of a deliberative democracy. Then, I illustrate the possible implications of those dialogic judicial tasks, by examining the role of judges in the face of popular consultations and plebiscites. The main example I use in my text concerns the case of the Acuerdos de Paz in Colombia, and the role of the Colombian Court in that regard.
