ABSTRACT

The overall logic of the book will be presented through an outline of the structure and the main issues discussed by the contributions which are part of it. However, it explores issues and attempts to outline answers and solutions which have a durable impact also in the context of the traditional constitutional order as it stands at the beginning of the twenty-first century. The aim of this chapter is not just to sketch or comment on this very important and somewhat contested decision of the German Constitutional Court but to put it in the context of ordering and adjusting the composite constitutional orders of the EU and its member states. It offers comparative study of the models for accommodation of ethno-national diversity in composite, fragmented, and pluralist societies. The chapter provides for comparative constitutional research focused on South Asia and Latin America. It starts with an outline of the main aspects of the crisis of constitutional democracy.
