ABSTRACT

This chapter aims to provide an outline of some of the conceptual issues related to the constitutional foundations of order and disorder viewed through the prism of peace and discontent. They have projections in the legal mentality, anthropology and consciousness of the people which is based on their socio-political acculturation, education and experience and is framed, thus also being influenced, by the constitutional foundations of peace and discontent. Hence, the first conceptual perspective differentiates between several constitutional models of peace and discontent putting the accent on different variants for organising the process for generating constitutional consensus and channelling of constitutional conflict. Their main role is to demonstrate the typology of the attitudes of the constitutional legislator towards peace and discontent and to show the main models for structuring of constitutional order and disorder, constitutional consensus, and constitutional conflict.
