Medical practitioners can only give their opinion on the injuries inflicted on the victim, the unusual causes of death and the possibility of ensanamiento on the victim. Within the jurisdiction of a criminal court, legal practitioners will never ask expert witnesses specializing in mental health, or forensic psychologists, about an individual’s intention to commit a violent crime based on the trauma inflicted. The victim died due to the sharp puncture wounds inflicted to the chest. The wounds could be considered as indicative of the perpetrator’s serious and harmful psychological state as well as aggressive behavior at the time of committing the crime. A priori, and before considering all of the evidence, it is very challenging for an expert witness specializing in mental health to determine the perpetrator’s intention based solely on the wounds they have inflicted, and whether their intention meets all the conditions for determining whether their mental state is impaired.
