ABSTRACT

This chapter describes and analyzes the institutional features of the National Assembly (NA) of the Socialist Republic of Vietnam. It focuses on ‘Assembly law’ or a body of laws about the structure and activities of the National Assembly of Vietnam. The Assembly law includes the 2013 Constitution and several statutes. The Constitution has a chapter on the NA (Chapter V) dealing with the institution's position, structure, powers, and the assembly deputies. Several new laws have been passed to give effect to these constitutional provisions. The 2014 Law on Organization of the National Assembly (hereinafter, Organic Law) details the provisions on the Constitution on this institution's structure and operation. The 2015 Law on Election of Deputies to The National Assembly and People's Councils (hereinafter, Election Law) establishes principles and procedures for national and local elections. The 2015 Law on Promulgation of Legal Documents (hereinafter, Legislative Law) provides for principles, authority, procedures for law-making of various institutions, including the National Assembly. The 2015 Law on Supervisory Activities of The National Assembly and People's Councils (hereinafter, Supervisory Law) provides detailed procedures for the exercise of the supervisory power of the National Assembly and local assemblies. The above Assembly laws have all been adopted by the NA. Courts in Vietnam do not have the power to interpret the Constitution and to review the constitutionality of legislation.
