ABSTRACT

Discipline in schools has become one of the topics on the headlines about news from the South African schools. School leaders are expected to be on top of their business regarding discipline and orderliness in schools. However, the legal framework governing disciplinary measures is dependent on the legal framework. This chapter conceptualizes and puts the notion of the legal status of teacher and school leaders in South Africa into perspective. This phenomenon is discussed in relation to both international and national literature. The challenges and opportunities for leading and managing school disciplinary processes in relation to education law are highlighted. The chapter draws some conclusions with regard to current state of school discipline and what needed to be done to improve school discipline.
