ABSTRACT

The idea of establishing an international framework to provide a minimum degree of legal protection for passengers carried by sea has been on the agenda of the international community for a considerable amount of time. The opinion that the legal position between the Athens regime and the Package Regulations 1992 requires a thorough scrutiny and this will form the subject-matter of the debate. The position was, of course, very different in the 1970s when the Athens Convention 1974 and the Convention on the Contracts for International Carriage of Passengers and Luggage by Road 1973 were promulgated. However, assuming that the ticket was purchased in the UK and the cruise included an international voyage, it is arguable that the rights of a passenger should be determined by the Athens Convention 1974, which applies in the UK by force of a law.
