ABSTRACT

The chapter addresses the right of children born from medically assisted procreation to know their origins. While many Western states have modified their laws to recognize such a right, to this day, the Province of Québec maintains the anonymity of the donor of gametes in the context of medically assisted procreation, even in the wake of allowing adopted children to have access to their origins. The chapter presents the legal framework of assisted procreation in Québec and the filiation of children conceived by such means. It then investigates the legal factors in favor of recognizing the right of children born of medically assisted procreation to know their origins, referring specifically to provisions of the United Nations Convention on the Rights of the Child (CRC) as well as case law on the matter.
