ABSTRACT

In light of the continuing concern with protection of the environment in armed conflict, this chapter focuses on the various attempts at standard setting by international decision makers. This chapter reviews the current treaty regimes in place for the protection of the environment in armed conflict. As there are limited treaty provisions it is also important to review the customary humanitarian law rules that apply to the environment. Finally, there is discussion of the important International Law Commission’s Draft Principles on Protection of the Environment in Relation to Armed Conflicts, which widens the temporal ambit of protection and brings environmental law and humanitarian law together.
