ABSTRACT

Cancellation of removal is a provision that allows certain foreign nationals to avoid deportation and be granted lawful permanent resident status. It requires showing “exceptional and extremely unusual hardship” to either oneself or a qualifying relative. This chapter details the requirements for this type of relief, including what constitutes “exceptional and extremely unusual hardship,” and illustrates several types of cases with fictional vignettes. It then describes the mental health professional’s role in the assessment process with focus on family dynamics, attachment styles, and evaluating children. The chapter ends with instructions on how to present the findings in a psychological report.
