ABSTRACT

This chapter explores new challenges to Spain’s condominiums amidst economic and pandemic crises. It also explores the equilibrium of individual and collective rights in Spain’s clear-cut condominium legislation, which has been the basis for the success of this ownership form. The chapter describes why the current legal framework has become insufficient to tackle more recent challenges while pointing to some possible reforms. Substandard and poorly maintained buildings present significant financial challenges for condo owners who share liability for costly repairs and replacements. The economic crisis has in many ways accelerated the deterioration of Spain’s housing stock. The poor conditions of condominiums are inseparable from the effects of the 2007 economic crisis on owners’ ability to pay monthly common fees. New technologies are rarely used to manage or make decisions within condominiums. In broad terms, ‘collaborative housing’ has been defined as the collaborative economy applied to the funding, access to, and organisation of housing.
