ABSTRACT

This chapter examines the liability for climate damage may encourage rapid transition, and the elimination of fossil fuels, as fast as technologically possible in the shipping industry. On the contrary, liability for climate damage is essential to ensure investments in infrastructure and technology are made, and to win the fight, particularly in shipping, for justice on a living planet. The ultimate cause of climate damage is therefore the failure of human institutions, and of our laws, to ban it. While current regulation and technology is inadequate, this chapter has explained how shipping corporations, and their directors, can be made liable for their contribution to climate damage. Climate damage, caused by burning coal, oil and gas, is the existential challenge of the 21st century, and the greatest threat to life on Earth since the end of the cold war. The basics of climate damage are well known in the 21st century.
