ABSTRACT

This article aims to analyse and provide some insight into how practitioners can provide pragmatic advice to their clients in dealing with planning decision-making involving heritage assets. It also aims to provide some insight into how decision-making relating to heritage assets is likely to play in the real world so as to enable a more predictive approach to be taken by practitioners. In doing so, it sets out the relationship between legislation and policy and details how this framework has been applied in the courts, planning inquiries and at local plan examinations.
