ABSTRACT

The capture of the CT has had a highly destructive impact on the level of protection of the rights and freedoms of individuals in Poland. The current Polish CT actively supports the parliamentary majority by cooperating with it in legalizing obviously unconstitutional law. The undesirable activism of the CT is accompanied by the gradual extinction of its judicial activity. The number of CT judgements has lessened noticeably in the last five years. The CT also receives fewer constitutional complaints and legal questions. Doubts regarding the legality of the appointment of CT judges and the validity of the CT judgements have resulted in citizens and judges having decreased confidence in the independent operation of the CT.
