ABSTRACT

The comparatist is for the jurists a kind of special envoy so that explains the old French joke: vive le droit compare qui nous fait voyager. The “basic research” on the subject therefore appears quite fundamental to open a debate and to identify the technical instruments to make effective the access to food, while respecting cultural traditions and markets. A crucial consideration is the statement that “necessities concerning food have always affected the inter-human relations transversally between law, religion and politics, often representing the jointure link of such elements”. The phenomenon is obviously not only European, although it was often considered, in the last century, only or mainly from the point of view of “rich Western Countries”. The issue is also very complex because the policy choices of individual governments often clash with society’s response and with situations that undermine the claim of equality in law.
