ABSTRACT

In this chapter, the authors discuss two case studies to illustrate the way in which students can explore the human rights implications of national immigration laws and international law for migrants, challenge them and pursue innovative ways in promoting the protection of migrant rights and social rights. The first case study derives from a higher education classroom setting in the United Kingdom, in which students explore the limitations of national and international immigration legal frameworks in the context of climate change. The second case study comes from a law clinic, in Spain, focusing on cases of migrants with HIV issues, through which students explore the relationship between health, immigration regulation, sexual orientation and other gender issues, assessing how international and domestic legislation interact.
