ABSTRACT

Nature is so closely linked to human beings that without her we could not survive (water, air, food…). However, due to the way we have considered her (an object, natural resource, res nullius, thing, or good to be appropriated), we are in a Sixth Extinction due to human causes. Human rights have not been a sufficient tool to confront such devastation that we, as a species, have caused. New paradigms, different ideas, and a different conception of law are needed. In certain new institutions of Andean neo-constitutionalism, such as Rights of Nature or Pachamama (Mother Earth), there is hope, if we take them seriously.
