ABSTRACT

The Court is composed of 15 judges, each of a different nationality, elected with an absolute majority by both the General Assembly and the Security Council. Judgments are without appeal, but are binding only for the particular case and between the parties. States appearing before the Court undertake to comply with its Judgment. If a party to a case fails to do so, the other party may apply to the Security Council, which may make recommendations or decide upon measures to give effect to the Judgment. An Advisory Opinion has been given at the request of the Security Council: Legal Consequences for States of the continued presence of South Africa in Namibia notwithstanding Security Council resolution 276. In July 1996 the Court delivered an Advisory Opinion on the Legality of the Use by a State of Nuclear Weapons in Armed Conflict, requested by the World Health Organization.
