ABSTRACT

This chapter examines consumer protection in cross-border disputes from a Japanese perspective. It clarifies the mechanisms of cross-border consumer protection in Japan, providing an overview of Japan’s choice-of-law rules and international adjudication jurisdictional rules to protect consumers. Subsequently, it covers the online dispute resolution (ODR) system in the United Nations Commission on International Trade Law (UNCITRAL) and the European Union (EU), because ODR has received attention worldwide as a prospective means to provide solutions for disputes in cross-border consumer transactions. This chapter compares the efforts made by regional and international organizations with those made by Japan to analyze and eliminate the challenges that it faces in introducing the ODR system into Japan.
