ABSTRACT

This chapter considers how cross-border insurance transactions by telecommunications are legally affected by the progress of InsurTech. InsurTech is an innovation in the insurance industry that utilizes new information and communication technology (ICT) or the new ICT that innovates the insurance industry.

Regarding insurance contracts, in general, cross-border transactions by telecommunications are greatly restricted by insurance regulations; thus, the first step is to review the current regulations on cross-border insurance transactions. Later, the chapter considers how the new risk-transfer agreements by InsurTech, which are index insurance and mutual-association-type peer-to-peer (P2P) insurance, will be treated by the regulations. In addition, it considers international private law issues, such as applicable law and jurisdiction issues, related to these new risk-transfer agreements.
