ABSTRACT

This chapter offers a brief but informative critical account of the constitutional model for emergency situations management in Bulgaria. Special attention is devoted to the judicial activism of the Bulgarian Constitutional Court related to mastering of emergency situations. First, the case law of the Bulgarian Constitutional Court related to military emergency situations and to the constitutional scheme for management of national defence issues is critically assessed. It has been mentioned that war, state of siege and state of emergency are the three regimes provided by the 1991 Constitution for mastering of emergency situations. It exposes the activist role of the Constitutional Court in shaping and mastering military emergency situations. The chapter explores the activist role of the Constitutional Court in shaping and mastering health-related emergency situations.
