ABSTRACT

The increasing access of Nigerians to smart phones and the internet has contributed to the rising instances of non-consensual pornography, also referred to as ‘revenge porn’ and ‘image-based sexual abuse’. While some developed jurisdictions have developed laws to tackle this menace, the same cannot be said of the Nigerian society. This chapter deployed the doctrinal method of legal research to assess the possible modes of combating non-consensual pornography through various legal alternatives including criminal and civil laws. Specifically, it examines the role copyright plays in combating this menace. While agreeing that copyright does not have all the solutions to the challenge, it is important that Nigeria reforms its laws to avail itself of the added protection that copyright law can give to the victims of such in the Nigerian society.
