ABSTRACT

This chapter discusses how fans, including cosplayers, can navigate issues of intellectual property and copyright. The chapter will begin by briefly defining Copyright – the protection of the creative expression of ideas – and Trademark – a mark the designates the origin of a good or service. The chapter will then also discuss the idea of “thick” copyright protection, meaning that highly creative works, for example works with a completely fanciful universe, receive more protection. Fair use will also be discussed. The chapter will explore how creators of characters, stories, and universes can protect their work with Trademark and Copyright laws. Further, it will explore how fans may legally use those creative works in their own creative activities such as cosplay. Finally, it will discuss how to balance these two interests.
