Is calling upon the court a way to acknowledge the responsibility of the Executive?

In France, the relationship between the State and the local and regional authorities is viewed in an unequal manner, which constitutes an obstacle to the State’s commitment to responsibility. However, the analysis of the case law helps to mitigate this first finding, as the judge is sometimes called upon to arbitrate a conflict between public persons and to bring out new hypotheses of responsibility.
